The unestablished agent is negatively defined with respect to the civil servant. For a long time, the hierarchy of power in the administration has disadvantaged unestablished agents. The reform policy, adopted since 1981 by the communist minister Anicet Le Pors and continued by the socialist Jean Le Garrec, attempted to modify this situation by limiting the recruitement of unestablished agents, by establishing many auxiliary agents and by granting them new rights. The civil servant unions found unconfortable the presence of the unestablished agents. At the same time, because they could not accept union's propositions, certain unestablished agents formed associations in order to defend their interests. But this effort is stagnating and its scale is limited.

Le non-titulaire est défini négativement par rapport au fonctionnaire. Pendant très longtemps, le rapport de forces dans l'administration a été en défaveur des agents non-titulaires. La politique de réforme, entreprise à partir de 1981 par le ministre communiste Anicet Le Pors et poursuivie par le socialiste Jean Le Garrec, a essayé de modifier cette situation en limitant le recrutement des non-titulaires, en titularisant de très nombreux auxiliaires et en leur accordant de nouveaux droits. Les syndicats de fonctionnaires n'appréciaient pas la présence des non-titulaires. Parallèlement, certains contractuels se sont constitués en associations pour faire valoir leurs intérêts car ils refusaient les propositions syndicales. Mais ce mouvement stagne et son ampleur est limitée.
