Le Président d’EPCI et la Loi NOTRe : le développement d’un leadership singulier en période de changements institutionnels

Recent territorial reforms in France contribute to create new balances of power, negotiation, local representation and domination between stakeholders but also between territorial organizations. Our study intends to examine the changes in local and regional authorities, and more particularly the roles and leadership of the presidents of EPCIs, the authority responsible for inter-municipal cooperation at the centre of the implementation of the new territorial governance. The NOTRe Act provokes a new coordination between territorial organizations, a redistribution of perimeters and a clarification of responsibilities on the territorial landscape, between local representatives and particularly on inter-municipal executives. Unprecedented legislative evolutions of the inter-municipal sphere offer EPCI presidents new conditions for the exercise of their mandate. They are linked notably to the transfer of responsibilities between local authorities and the new expansion of territorial perimeters. We pay a particular attention to the new distribution of local powers and their repercussions in terms of leadership. In our case study, we conduct a detailed analysis of the ins and outs allowing the supremacy of the president of EPCI at the center of the local public sphere ; at the heart of trade-offs between managerial and democratic rationality. This work sheds additional light on the role played by local representatives, their future within the local political landscape as well as on the new sources of action on a municipal scale.

Les transformations institutionnelles récentes de l’action publique locale contribuent à créer de nouvelles formes de rapport de force, de négociation, d’incarnation (ou de représentation) locale et de domination entre acteurs mais également entre organisations territoriales. Notre étude se propose d’examiner les mutations des collectivités territoriales et plus particulièrement les rôles et le leadership des présidents d’établissements publics de coopération intercommunale (EPCI) chargés de la mise en œuvre de la nouvelle gouvernance territoriale. La Loi NOTRe provoque une nouvelle coordination entre organisations territoriales, un redécoupage des périmètres et une clarification des responsabilités sur les organisations territoriales en présence, sur les élus locaux et particulièrement sur les exécutifs intercommunaux. Les évolutions législatives qui concernent la sphère intercommunale offrent aux présidents d’EPCI des conditions inédites d’exercice de leur mandat. Elles sont liées notamment aux transferts de compétences et au nouvel agrandissement des périmètres territoriaux. Il s’agit de s’intéresser particulièrement aux nouvelles conditions de répartition des pouvoirs locaux et aux incidences en termes de leadership. L’objectif de notre étude cas consiste à analyser les tenants et aboutissants plaçant le président d’EPCI au centre de la sphère publique locale, au cœur d’arbitrages entre rationalité managériale et rationalité démocratique. Ces travaux offrent un éclairage supplémentaire sur le rôle des élus locaux, leur avenir au sein du paysage politique local ainsi que sur les nouveaux ressorts de l’action du niveau communal.
