Objective law to Léon Duguit can be defined as a concept of the whole characterized by a concrete assessment, a positive law based on solidarity or social interdependence; it can also be defined as the result of the reciprocal action of the rulers on the governed and the governed on the rulers, in terms of legal effects. This notion, developed during the prime period of public service, makes it possible to use a historical conception of law to analyze contemporary positive law. It is indeed a question of endeavoring to consider the current effects, as well in doctrine as in positive law, of the thought of Léon Duguit relating to the concept of objective law. In this sense, the analysis of the notion of objective law is inseparable from a work in connection with current legal developments, having the ambition to clarify the orientations of positive law and to offer an original reading, in particular under the angle of the principle of solidarity attached to the notion of objective law, which can for example be illustrated in public service law.

Le droit objectif chez Léon Duguit peut se définir comme une notion caractérisée par une appréciation d’ensemble, concrète, d’un droit positif fondé sur la solidarité ou l’interdépendance sociale ; il peut aussi se définir comme le résultat de l’action réciproque des gouvernants sur les gouvernés et des gouvernés sur les gouvernants, en termes d’effets de droit. Cette notion, élaborée durant la période reine du Service Public, permet l'utilisation d'une conception historique du droit pour analyser le droit positif contemporain. Il s'agit en effet de s’attacher à considérer les effets actuels, aussi bien en doctrine qu’en droit positif, de la pensée de Léon Duguit relative à la notion de droit objectif. En ce sens, l’analyse de la notion de droit objectif est inséparable d’un travail en lien avec l’actualité du droit, ayant pour ambition d’éclairer les orientations du droit positif et d’en proposer une lecture originale, notamment sous l’angle du principe de solidarité attaché à la notion de droit objectif, pouvant par exemple s’illustrer en droit du service public.
