The article 1a20 is the foundation of the definition of the status of political refugees. In addition to classical types of refugees there can be found new groups of them; especially those fleeing from armed conflicts, systematic and glaring violations of human rights, interethnic disorders, economic oppression, etc. All the problems faced by those new refugees could be solved by a dynamic interpretation of the article 1a20. In this regard we recommand an interpretation that lies in: - setting an average threshold of gravity, from which could be proven persecution as defined by the convention -considering all the other elements of the definition-, in order to protect people whose situation is most perilous. - refering to international statute law about human rights, international criminal law, international humanitarian law and any other relevant international law. The regional evolution should be taken into consideration when it can be used as a model of legislation on a worldwide scale, as for the convention of refugees of u. A. O. To illustrate the common practice of states, we will study the french and german practices in regard to the article 1a20.

L'article 1a20 est le fondement de la definition du statut de refugie politique. Aux refugies politiques classiques s'ajoutent de nouveaux groupes de refugies que sont notamment les refugies fuyant les conflits armes, les violations systematiques et flagrantes des droits de l'homme, les troubles inter-ethniques, l'oppression economique etc. . . . Une interpretation dynamique de l'article 1a20 pourrait repondre a tous ces nouveaux problemes de refugies. Nous preconisons a cet egard une interpretation consistant: - a retenir un seuil de gravite moyen, a partir duquel il y a une persecution au sens de la convention, en fonction de tous les autres elements de la definition, afin de proteger les personnes dont la situation est la plus perilleuse. - a se referer au droit international des droits de l'homme, au droit international penal, au droit international humanitaire et a toute autre matiere pertinente de droit international. L'evolution au niveau regional devrait etre prise en consideration lorsqu'elle pourrait servir de modele au niveau universel, comme c'est le cas pour la convention des refugies de l'o. U. A. Les pratiques francaises et allemandes relatives a l'application de l'article 1a20 sont examinees a titre d'exemple pour illustrer la pratique des etats.
