The jurisdictional function of the lebanese "conseil d'etat" is not a simple question of judicial technique, but on the contrary, it presents a system which reveal the essential characteristics of the state. In other words it determines a choice in the law concerning the politics and the philosophy of the regime. The success of such a function is measured by its exercice, i. E, according to its ability to represent in our administrative justice. Although this function is important from the judicial point of view, it is not sufficient in practice. That is why a sociological approch is necessary to appreciate the manifestations of this function "in acts", and consequently to situate the person of the citizen, for whom the jurisdictional function exists and which is in itsemf the justification and the aim. Our aim has been to establich the link between the mecanist or static function and the dynamic one of the libanese "conseil d'etat", to show the reality of our administrative jurisdiction as well as to find a solution for it.

La fonction juridictionnelle du conseil d'etat n'est pas une simple question de technique juridique, bien au contraire, elle met en scene un systeme qui revele les caracteristiques essentielles de la forme etatique. Autrement dit elle determine un choix dans le droit en ce qui concerne la politique et la philosophie du regime. La reussite d'une telle fonction se mesure sur le terrain de son exercice, c'est a dire selon le degre de sa representativite dans notre justice administrative. Bien que cette fonction soit importante sur le plan juridique, elle n'est 1as suffisante en pratique soit a elle seule. C'est pourquoi une approche sociologique s'est revelee importante pour apprecier les manifestations de cette fonction "en actes", et par consequent pour situer la personne du citoyen, pour qui la fonction juridictionnelle est faite et qui en est la justification et le but. Pour ce faire nous avons essaye d'etablir la liaison entre la fonction mecaniste ou statique et la fonction dynamique du conseil d'etat libanais pour montrer la realite de notre juridiction administrative ainsi que pour en deduire une solution.
