This thesis deals with the problem of private high schoole and universities in france. In the first part the author gives a definition of higher education and volontary effort for education in france (freedom of education). The second part describes laws concerning the structures of higher education in france : agriculture highschools, private universities, artistic schools, technical schools, paramedical schools, distance teaching. The third part deals with the problems of diploma and state financing of private establishments.

La these est consacree a l'etude des regimes juridiques applicables aux etablissements prives d'enseignement superieur. Dans une premiere partie les notions d'enseignement superieur et de liberte de l'enseignement sont decrites au travers des textes qui les visent. La seconde partie est consacree aux textes relatifs aux diverses formes de l'initiative privee: enseignement universitaire, technique, agricole, artistique, paramedical, a distance. La troisieme partie decrit la question des diplomes d'enseignement superieur ainsi que celle du financement public des etablissements prives.
