Le principe de neutralité dans la fonction publique

The examination of the situation of the French civil servants as well as the British and the American ones, from the French revolution till today, proves clearly one variant determination of the legislator and the administrative judge, with unequal results, to eradicate the different types of politicization in the administration of the civil service. But the civil servant has not become a politically diminished citizen, in contrast to that which occured in Great-Britain and the United States. The effort to protect neutrality of the civil service resulted in the adoption of the different laws (statutes) which, from 1946, constitutes one efficient way to shield the (French) civil service from the partisan pressures by assuring its independance impossible without the subordination to the political power. But there are still multiple causes of politicisation. The increasing participation of the civil servants in politics ("fonctionnarisation du pouvoir politique"), the politicization if the higher civil service and syndicalism are also factors which accent the interest int he current debates concerning the better protection of neutrality

L'examen de la situation des fonctionnaires français, mais aussi britanniques et américains, de la révolution française à nos jours, montre une volonté (du législateur et du juge administratif) plus ou moins marquée, aux résultats inégaux, d'éradiquer les différentes formes de politisation dans la gestion de la fonction publique. Nonobstant, le fonctionnaire n'est pas devenu un citoyen politiquement diminué, à l'inverse de ce que l'on constate en Grande-Bretagne et aux Etats-Unis. L'effort pour protéger la neutralité de la fonction publique aboutit à l'édifice statutaire qui, depuis 1946, constitue un moyen efficace pour soustraire la fonction publique aux pressions partisanes en assurant son indépendance, inenvisageable sans la subordination au pouvoir politique. Pourtant, il existe encore de multiples sources de politisation. La fonctionnarisation du pouvoir politique, la politisation de la haute fonction publique et le syndicalisme sont autant de facteurs qui soulignent l'intérêt et l'actualité des débats quant à une meilleure protection de la neutralité
