This study is based on the controversial question of the place of the religious sects in the judicial system and in the french society. We can state that in the framework of our applied legal system these groups have the possibility to exist judicially. But the administration of the cults is not adapted to their situation. The absence of objectifivty in the notion of the public order and above all the consideration of the general interest contribute to limit the exercise of the desired rights of the sects. Although it is extremey rare that the associations created by the sects end their legal existence by dissolution, their legal life is hard pushed to the administrative and juridictional limit.

L'etude porte sur la question controversee de la place des sectes religieuses dans l'ordre juridique et dans la societe francaise. Nous pouvons constater que ces roupements ont, dans le cadre de notre droit positif, la possiblilite d'exister, juridiquement. Cependant le regime des cultes est inadapte a leur situation. L'absence de neutralite de la notion d'ordre public, mais surtout la prise en compte de l'interet general, contribuent a limiter l'exercice des prerogatives que les sectes revendiquent. S'il n'est que tres rarement mis fin a leur existence juridique, par la dissolution des assoiciations qu'elles ont constituees, leur "vie juridique" se heurte a des limites d'origine administrative et juridictionnelle.
