Even when a new deontologic moral code is studying and that relations between the order of medical doctors and ministery are increasing in the aim of proceeding to the reform of the council of order of medical doctors, it was necessary to take stock of this institution. In fifty years, the order of medical doctors has striven to apply the existing texts, filling sometimes their gaps, but also to make the elaboration of criterions of each disciplinary fault. The study of this evolution induce us to establish two phenomenons : -- the existing of gaps and insufficencies concerning the functioning of the disciplinary procedure ; -- the existing of a duality within the ordinal institution. Within this jurisdiction of an administrative type, we can find a new type of repressive judges. Moral become deontology is changing in disciplinary penal code.

Alors qu'un nouveau code de deontologie est a l'etude et que les relations ordino-ministerielles se sont renforcees en vue de proceder a la reforme du conseil de l'ordre des medecins, il convenait de faire le point sur cette institution. En cinquante ans l'ordre des medecins s'est efforce d'appliquer les textes existants en comblant parfois leurs lacunes mais aussi d'assurer l'elaboration des criteres determinant la realisation de chaque faute discplinaire. L'etude de cette evolution nous conduit a constater deux phenomenes : -- l'existence de lacunes et insuffisances touchant au fonctionnement de la procedure disciplinaire et engendrant une meconnaissance des droits de la defense et une inegalite entre medecins -- l'existence d'une dualite de l'institution ordinale : au sein de cette juridiction de type administratif, se trouvent des juges repressifs d'un genre nouveau. La morale devenue deontologie se transforme en code penal disciplinaire.
