The objective of this study consists on the one hand, in the presentation and the analysis of the national and international law rules which govern the achievement of foreign investments in greece and on the other hand, in the demonstration of the correlation which exists between the legislative policy toward investments of a country and the economic objectives of this one. The analysis of the legal framework for foreign investments in greece, includes two parts. In a first part, we will study the rules of constitution and liquidation of foreign investments in greece. Since the entry of this country in the eec, these scopes are governed by community legislation's provisions that greek law had to implement. In a second part, we will analyse the legal framework of treatment and protection of foreign investments in greece, scopes which are regulated by greek national law or because of the instability of this one, by international law (bilateral conventions for the mutual promotion and protection of investments and multilateral agreements that deal with foreign investments).

L'étude du cadre juridique des investissements étrangers en Grèce a pour objet d'une part, de présenter et d'analyser les dispositions de droit interne et de droit international qui régissent la réalisation d'un investissement étranger en Grèce et d'autre part, de démontrer au travers de cette analyse, l'étroite corrélation qui existe entre les objectifs économiques d'un pays et sa politique en matière d'investissement. Un bref rappel de l'évolution du régime juridique de l'investissement étranger en Grèce depuis l'accession de ce pays à l'indépendance (1828) jusqu'à son entrée dans la CEE le 1er janvier 1981, s'avèrera nécessaire afin non seulement de démontrer le rôle capital et permanent des investissements étrangers dans le développement économique de la Grèce mais aussi afin de souligner la portée des changements opérer depuis l'adhésion de la Grèce aux communautés européennes. L'analyse du régime juridique actuel de l'investissement étranger en Grèce s'effectuera en deux temps. Dans une première partie intitulée le domaine communautarise, seront présentées les conditions de constitution et de liquidation de l'investissement étranger en Grèce.
