The growth of the transport by land network in europe raises many questions about the protection of the environment. European law provides some answers, including the provision of legal instruments to include the environment in decision process. In 1985, the community institutions adopted the council directive 85 337 on the environmental assessment of some private and public projects. This was the first step tpwards the integration of environmental concerns into the approval procedure of road and railway projects. This directive is, however, limited to the project level; the environment is therefore not taken into consideration during the decision stage. The european community has already intervened in community financing procedures of roads and railways regarding environmental matters. They now have to intervene during the initial stage of the decision-making process, that is, at the level of plans, politics and programmes which concern national and european transport networks.

Le developpement des infrastructures de transport terrestre en europe souleve de nombreuses questions liees a la protection de l'environnement. Le droit europeen apporte certaines reponses, parmi lesquelles la mise en place de mecanismes juridiques visant a prendre en compte l'environnement dans les processus decisionnels. Avec l'adoption en 1985 de la directive communautaire relative a l'evaluation des incidences sur l'environnement de certains projets publics et prives, les autorites communautaires ont fait un premier pas vers l'integration des considerations environnementales dans les procedures d'autorisation ou d'approbation des projets d'infrastructures routieres et ferroviaires. Cette directive se limite, toutefois, au stade de la realisation du projet et ne permet pas une prise en compte de l'environnement en amont du processus decisionnel. La communaute europeenne est intervenue en tenant compte des considerations environnementales dans les procedures de financements communautaires des infrastructures de transport. Il reste a intervenir aux premiers stades du processus decisionnel, c'est-a-dire au niveau des plans, politiques et programmes relatifs a la realisation de reseaux routiers ou ferroviaires transeuropeens au nationaux.
