The sources of french administrative law have always been atypical. In a country which is said to be based exclusively on statute law, case-law has long made up for the shortcomings of administration law. Judge-made law however is being questioned today. This present thesis is aimed at underlining the current development of the sources of administrative law and analyzing its repercussions on administrative case-law and judges. Research has led us to single out three transformations. First and foremost the constitutional source of administrative law is asserting itself in relation to the traditional case-law origin (part i). The emergence of the constitutional source (chapter i) does not result however in the administrative legal system's complying unconditionally with constitutional rules (chapter ii). On the other hand, community sources and internal ones are at variance as far as administrative law is concerned (part ii). The growth of the community sources is due to a great extent to the work of the court of justice of the european community (chapter i). Reactions from the french conseil d'etat are diverse on this matter. Its judicial decisions sometimes stand by positions which are hardly sympathetic to the community's legal order, and sometimes, on the contrary, it gives it much more favourable consideration (chapter ii). Les sources du droit administratif francais ont toujours ete atypiques. Dans un pays qui officiellement ne releve que du droit ecrit, la jurisprudence administrative a longtemps pallie les carences du legislateur. Cette oeuvre pretorienne est cependant aujourd'hui remise en question. La premiere these a pour objet de mettre en evidence l'evolution actuelle des sources du droit administratif et d'en analyser les repercussions sur la jurisprudence et le juge administratifs. Notre recherche nous a conduit a relever trois mutations principales. En premier lieu, on assiste a l'affirmation de la source constitutionnelle du droit administratif, face a la source jurisprudentielle traditionnelle (premiere partie). L'emergence de la source constitutionnelle (chap. I) n'aboutit toutefois pas a une soumission absolue du droit administratif aux normes constitionnelles (chap. Ii). D'autre part, le droit administratif est le lieu d'une confrontation des sources communautaires et internes (deuxieme partie). Le developpement des sources communautaires resulte pour une tres large part de l'action de la cour de justice des communautes europeennes (chap. I). Le conseil d'etat reagit ici de maniere contrastee. Sa jurisprudence se montre tantot fidele a des positions peu favorables a l'ordre juridique communautaire, tantot a l'inverse beaucoup plus accueillante a l'egard de ce dernier (chap. Ii). Faconne par ces deux nouvelles sources, le droit administratif temoigne enfin d'un reequilibrage des sources ecrites et jurisprudentielles internes troisieme partie).
