Le constitutionnalisme marxiste en Afrique noire : l'exemple du Bénin

In legitimizing the regime issued from the pretorian intervention of october 1972, the fundamental law adopted in Benin in august 1977, put an end to the constitutional void of several years. Moreover, this fundamental law proves the adherence of the military leaders to marxist constitutionalism after their official option for scientific socialism. This constitutionalism focuses on the political liberation and economic of the country on the path towards socialism. But it appears that in spite of the remarkable institutional stability with which the actual regime can be credited, neither one of the objectives have been able to be achieved. This can be explained by the unadapted law as well as by the existence of numerous other factors (endogenous, exogenous), impediments to progress. It is thus important to first remedy the actual constitutional relativism by elaborating a new constitution, not only applicable but really applied.

En légitimant le régime issu de l'intervention prétorienne d'octobre 1972, la loi fondamentale adoptée au Bénin en aout 1977, mit fin à un vide constitutionnel de plusieurs années. En outre, elle témoigne de l'adhésion des gouvernants militaires au constitutionnalisme marxiste après leur option officielle pour le socialisme scientifique. Ce constitutionnalisme vise la libération politique et le développement économique du pays dans la voie du socialisme. Mais, l'analyse fait ressortir qu'en dépit d'une remarquable stabilité institutionnelle à mettre à l'actif de l'actuel régime, ni l'un, ni l'autre objectifs n'ont pu être atteints. Ceci peut s'expliquer tant par l'inadaptation du droit que par l'existence de nombreux autres facteurs (endogènes et exogènes) dirimant au progrès. Il importe donc de remédier d'abord au relativisme actuel du constitutionnalisme par l'élaboration d'une nouvelle constitution qui soit, non seulement applicable, mais réellement appliquée.
