The thesis says : the conceptualisation of the European Constitution is the conceptualisation of a European State. The theoretical implications concern international law as well as constitutional law : the European Community, as soon as we evocate a State logic, in at the core of the mutation of the international law environnement. . . The positive formulation of the notion of sovereignty is the expression of the "synthesis" of the juriprudential constitutional law with regard to the relations between community and national laws. . .

Le travail de recherche part du postulat selon lequel penser la Constitution européenne, c'est penser l'Etat européen. Envisager un processus de constitutionnalisation du droit communautaire, c'est donc envisager le processus devant conduire à un Etat Les implications théoriques d'un tel postulat concernent aussi bien le droit international public que le droit constitutionnel : la Communauté européenne, soumise à une logique d'Etat, est au coeur d'une mutation de l'environnement juridique unternational. . . La formulation positive de la notion de souveraineté est l'expression d'une "synthèse" du droit constituionnel juriprudentiel national afférent aux rapports entre ordre juridique interne et communautaire. . .
