Abstract EN:

The sui generis construction of the European Union marks the birth of the European constitutionalism, which develops by the change in the formulation of the traditional concepts of the general constitutional law. The draft treaty aiming at establishing a Constitution for Europe constitutes a political-legal act for the organization of the States nations in supra-national States unitary structures. The European Constitution integrates the European Convention of human rights to the Community legality, in order to ensure the protection of European citizens. In the European legal system, the decisions of the Court of Justice of the European Communities, of the European Court of human rights, as well as those of the Constitutional Courts, become an important legal precedent, which promotes European constitutionalism, in spite of the attachment of the States Member in correlation to sovereignty and democratic bond (for example the case of Greece).

Abstract FR:

La construction sui generis de l'Union européenne marque la naissance du constitutionnalisme européen, qui se développe par la mutation dans la formulation des concepts classiques du droit constitutionnel général. Le projet établissant une Constitution pour l'Europe constitue un acte politico-juridique de l'organisation des Etats nations en structures unitaires supra-étatiques. La Constitution européenne intègre la Convention européenne des droits de l'Homme à la légalité communautaire, en vue d'assurer la protection des citoyens européens. Dans le système juridique européen, les décisions de la Cour de justice des Communautés européennes, de la Cour européenne des droits de l'homme, ainsi que celles des Cours constitutionnelles, deviennent un précédent juridique important, qui promouvoit le constitutionnalisme européen, malgré l'attachement des Etats membres aux rapports de souveraineté et au lien démocratique (p. Ex. La cas de la Grèce).
