The invocation of the "republican tradition" by;. Politicians seems to have very few grounds on the whole, scientifically and materially in the sight of the history of republican practices and legal texts. This study presents " the republican tradition " has a series of valves integrated intow the republic. As for the legal import of this notion, it generaly seem ineffective and it can be found used by the judge in other expressions. Unlikely to be analyses has a constitutional custom, the " republican tradition " neverthelses fulsils some juridical functions and seems to be root of certain legal rules.

L'invocation de la " tradition republicaine " par des hommes politiques apparait globalement tres peu fondee scientifiquement et materiellement au regard de l'histoire des pratiques et des textes juridiques republicains : cette etude fait comprendre la " tradition republicaine " comme un ensemble de valeurs integrees par la republique. Quant a la portee juridique de cette notion, elle semble generalement inoperante et se trouve utilisee par le juge sous d'autres expressions. Insusceptible d'etre analysee comme une coutume constitutionnelle, la " tradition republicaine " remplit pourtant certaines fonctions juridiques et parait etre a la source de certaines egles de droit.
