Historical study about the birth of Council of State as a Government counsellor also adding the date of creation of legal department. A parallel has then been drawn between this study and the separation of powers and the evolution of the executive function. Therefore the fallowing question grows : which of these three constituted powers assumes the legislature? At the limit between the Parliament and the Government, the Council of State has a privileged position among our institutions. This position allows it when functioning as counsellor, to hold quite an important position in the legislative process as well. It then appears necessary to wonder about the basic meaning of having the Council of State assuming a legislative function in the first hand, theway it fulfils its mission in the second hand and finally to judge about the results particular themes and periods.

Étude historique de la naissance du Conseil d'État en tant que conseiller du Gouvernement, sans toutefois oublier de fixer la date de création de la section du contentieux. Parallèle fait avec la séparation des pouvoirs et l'évolution de la fonction exécutive. L'interrogation naît : lequel des trois pouvoirs constitués détient le pouvoir législatif ? À la croisée entre le Parlement et le Gouvernement, le Conseil d'État occupe une place privilégiée au sein de nos institutions. Cette position lui permet, lorsqu'il exerce sa fonction de conseil, d'avoir une importance non négligeable dans le processus législatif. Il est nécessaire de s'interroger sur les fondements de l'exercice de la fonction législative par le Conseil d'État, puis les moyens utilisés par ce dernier pour remplir sa mission et enfin en apprécier le résultat au travers de thèmes et de périodes délicates.
