In italy, legislative acts taken by the government and enforced after having been authorized by parliament - or in some extraordinary circumstances - have the same status as laws passed in parliament the italian constitutional court has defined various criteria to distinguish these acts from those adopted according to usual proceedings and the court's jurisdiction is all the more important because of the ever-increasing use of such acts. Deciding whether such acts are constitutional or not leads the judge to maintain or re-establish a balance between the powers of the state in accordance with the constitution of 1947.

Les actes legislatifs du gouvernement en italie ont immediatement valeur de loi des leur adoption, et sont habilites a modifier des lois formelles. La pratique a banalise leur usage, et dans ce cadre, le role joue par la cour constitutionnelle qui controle tout acte ayant valeur de loi, prend toute son importance. La cour a degage divers criteres pour identifier ces actes gouvernementaux, et le controle de leur constitutionnalite a conduit le juge a maintenir ou retablir l'equilibre entre les pouvoirs de l'etat dans l'esprit de la constitution de 1947.
