Abstract EN:

The balance translates, in contract law administrative, a protean ans unstable reality. On one hand, it contains a double material and temporal dimension, on the other hand, its content varies according to the degree of administrativité and of intensity of public contratcs. Nevertheless, of the fact of its flexibility, the notion of contractual balance may become a central element of the administrative law while its persevering plasticity represents a danger of arbitrary power. Constituting a model in which to refer to determine the normal contractual administrative situations, the balance of public contracts participates of the normality ot last ones. However, this normality is elusive because not only, it bases on the double institutionnal and relational rationality of public contracts but it translates another évolutionary opportunity. The balance is thus a real standard of the contract law administrative.

L’équilibre traduit, en droit des contrats administratifs, une réalité protéiforme et mouvante. D’une part, il comporte une double dimension matérielle et temporelle, d’autre part, sa teneur varie en fonction du degré d’administrativité et d’intensité contractuelle des contrats administratifs. Pourtant, du fait même de sa flexibilité, la notion d’équilibre contractuel est susceptible de devenir un élément central du droit administratif alors que sa plasticité persistante représente un danger d’arbitraire. Constituant un modèle auquel se référer pour déterminer les situations administratives contractuelles normales, l’équilibre des contrats administratifs participe de la normalité de ces derniers. Cependant, cette normalité est fuyante puisque non seulement, elle repose sur la double rationalité institutionnelle et relationnelle des contrats administratifs, mais elle traduit encore une opportunité évolutive. L’équilibre est donc un véritable standard du droit des contrats administratifs.
