La coopération sanitaire entre le conseil de l'Europe et l'union européenne

This study concerns the development of the cooperation between the Council of Europe and the European union in the field of health : its origins, its juridical basis. The cooperation with the Council of Europe in the field of health is established by many articles of the Treaty establishing the European Community. The article 152 § 3 stipulates the cooperation with international organizations who have legal capacity in the field of the health. The health is the one of various Fiels of action of the Council of Europe. The Treaty of the European Community contains a article 303 who establish all appropriate forms of cooperation with the Council of Europe. This cooperation has been strengthened by two exchange of letters between the Secretary general of the Council of Europe and the President of the European Commission dated in 1987 and 1996. In the Public health, the cooperation concerns many areas as drug, the blood transfusion, organ transplantation, the health education for the young, the health in the sport, especialy the doping. A close collaboration is developped between the European Community and the Pompidou Group since the creation of the EMCDDA. The cooperation has been materialized with the European Community accession to the european convention on Pharmacopoeia and to the agreements of the Council of Europe in the areas of health ( Agreements EST n° 26, 33, 39 and 84). The Council of Europe and the European Community share the same values and pursue common aims with regard the protection of democracy, respect for human rights. These common aims have led the Council of Europe and the European Commission in recent years to develop a number of joint programmes for cooperation with countries wich have joined the Council of Europe since 1989, or have applied for membership. Joint activities are developped in the areas of mental health, organ transplantation and the biothics in the countries from central and eastern Europe. In addition, this cooperation would be strengthened with the Council of Europe, if the Treaty establishing a Constitution For Europe intry into force, and would create the Public Good in the area of health. We would tackle the health by the angle of human rights and the problem set by the EC/EU accession to the instrument of the Council of Europe in the field of human rights. The future cooperation between the Council of Europe and the European Union would explore new options like the participation of EC/EU as a membership of the Council of Europe, or the extension of European Communiy directives in the field of health to the countries who are members states of the European Council, or have applied or not applied for membership, and a agreement of partenership between the European union and the Council of Europe in the field of health would ensured maximum benefit for the two european organizations. The cooperation between borders countries in the field of heatlh would concern the countries in transition who are members states of the Council of Europe and the membres states of European union, and should include the watching of transmissible diseases and the using of medical equipements.

Cette étude concerne le développement de la coopération sanitaire entre le Conseil de l'Europe et l'Union européenne : ses origines et ses fondements juridiques. La coopération sanitaire avec le Conseil de l'Europe se fonde sur plusieurs dispositions du Traité CE. L’article 152 paragraphe 3 mentionne expressément la coopération avec les organisations internationales compétentes en matière de santé publique. La santé fait partie du programme des activités du Conseil de l'Europe. Le Traité CE stipule également, à l'article 303, l'établissement de toutes coopérations utiles avec le Conseil de l'Europe. Cette coopération sanitaire a été élargie par deux échanges de lettres entre le Secrétaire général du Conseil de l'Europe et le Président de la Commission des Communautés européennes ( 1987 et 1996). En ce qui concerne la santé publique, la coopération porte sur des domaines tels que la drogue, la transfusion sanguine, la transplantation d’organes, l'éducation pour la santé chez les jeunes, la santé dans le sport, en particulier le dopage. Il existe aussi une coopération étroite entre la Communauté européenne et le Groupe Pompidou depuis la création de l'OEDT. En outre, cette coopération accrue avec le Conseil de l'Europe s’est concrétisée par l'adhésion de la Communauté européenne à la Convention relative à l’élaboration d'une Pharmacopée européenne et aux Accords européens du Conseil de l'Europe en matière de santé publique ( Accords STE n° 26, 33, 39 et 84). Le Conseil de l'Europe et la Communauté européenne partagent les mêmes valeurs et poursuivent des objectifs communs en ce qui concerne la défense de la démocratie et le respect des droits de l’homme. Ceci a amené le Conseil de l'Europe et la Commission européenne, au cours des dernières années, à élaborer un certain nombre de programmes conjoints de coopération avec des pays qui sont devenus membres du Conseil de l'Europe depuis 1989 ou sont candidats à l’adhésion. Ces activités conjointes concernent la santé mentale, la transplantation d'organes et la Bioéthique dans les Pays d'Europe centrale et orientale. Enfin, cette coopération avec le Conseil de l'Europe dans le domaine de la santé pourrait, si le Traité établissant une Constitution pour l'Europe entre en vigueur, favoriser l'émergence de Biens publics européens dans le domaine de la santé. Il est notamment envisagé d'aborder la santé sous l’angle des droits de l'homme et de poser la problématique de l'adhésion de la CE/UE aux instruments relatifs aux droits de l’homme du Conseil de l'Europe. La coopération sanitaire future entre le Conseil de l'Europe et l'Union européenne devrait explorer des options nouvelles telles que la participation de la CE/UE comme membre du Conseil de l'Europe, ou l'extension des Directives communautaires en matière de santé publique aux Etats membres du Conseil de l'Europe, candidats ou non à l'adhésion, et la conclusion d'un accord d'association entre l'Union européenne et le Conseil de l'Europe en matière de santé publique pourrait à terme renforcer la coopération sanitaire entre les deux organisations européennes. La coopération sanitaire transfrontalière entre les pays en transition du Conseil de l'Europe et les Etats membres de l'Union européenne pourrait porter sur la surveillance des maladies transmissibles et l'utilisation partagée des équipements médicaux.
