The choice of a market economy with free competition deeply changed relations between the state and the market. If the state can help, encourage, gift support to the economic operators in accordance with competition regulation, it usually gives up substituting itself for the market mechanisms and private firms. Guarantor for the general interest, the state nevertheless retains significant responsibility in the organization of the market. It must ensure the smooth running of the market and the practice of a workable competition while guarantying the respect for the essential demands of the community. The study of the state and the ways of market organization, which reveals the multi-faceted and protean relations the market to the general interest, leads to wonder about the conception and the place of state in a market economy.

Le choix d'une économie de marché ouverte où la concurrence est libre a profondément modifié les relations entre l'Etat et le marché. Si l'Etat peut aider, inciter et accompagner les opérateurs économiques dans le respect des règles de concurrence, il renonce généralement à se substituer aux mécanismes du marché et aux entreprises privées. Garant de l'intérêt général, l'Etat conserve néanmoins une responsabilité éminente dans l'organisation du marché. Il doit veiller au bon fonctionnement du marché et à l'exercice d'une concurrence efficience tout en garantissant le respect des exigences essentielles de la collectivité. L'étude de l'Etat et des modes d'organisation du marché, qui révèle la relation complexe et protéiforme qui unit désormais le marché et l'intérêt général, amène à s'interroger sur la conception et la place de l'Etat dans une économie de marché.
