Solidarity is a concept difficult to define. Encompassed by political science, economics, social science and law, solidarity, seldom defined, remains a vague and ambiguous concept. Often discredited by positivist jurists, but dear to objectivists, its links to law are not any less concrete. It represents the social link at the base of the formation of a group, and thus at the base of the formation of the law, according to the expression ubi societas, ibi jus. The study of the instruments of solidarity in international law reveals the different forms that solidarity takes, according to whether it develops within the sphere of the society of states, characterised by the supremacy of the principle of sovereignty, or within the sphere of the international community, which implies that states accept their interdependence. This study will allow us to determine the place of solidarity in international law and its scope in the international legal order.

Abstract FR:

La solidarité est une notion difficile à définir. Accaparée par le politique, l’économique, le social, le juridique, la solidarité, rarement définie, reste une notion vague et ambiguë. Souvent discréditée par le juriste positiviste, bien que chère aux objectivistes, elle n’en présente pas moins des liens évidents avec le droit. Elle représente le lien social à la base de la formation du groupe et donc à la base de la formation du droit, selon l’expression ubi societas, ibi jus. L’étude des instruments de solidarité en droit international public met en évidence les différentes formes que prend la solidarité, selon qu’elle se développe dans le cadre de la société des Etats, caractérisée par la suprématie du principe de souveraineté, ou dans le cadre de la communauté internationale qui implique l’acceptation, par les Etats, de leur interdépendance. Cette étude permettra de déterminer la place de la solidarité en droit international et sa portée dans l’ordre juridique international.
