The existence and activities of the International Tribunal for the Law of the Sea contribute to a process of jurisdictionalization of international law which has an incidence on the progressive transformation of international law. The Tribunal's contribution depends on the confidence it inspires. Therefore, the Tribunal has to be attractive and has to guarantee the respect of the principle of good administration of justice. The Tribunal's contribution is also characterized by a specialization which is shaped by its jurisdiction. If this jurisdiction is apparently wide, it remains in fact voluntarily limited. The specialization has furthermore an influence on the role played by the Tribunal because of its incidence on the development of the rule of law by the judges and on the Tribunal's place in the international legal order.

L'existence et les activités du Tribunal international du droit de la mer participent d'un mouvement de juridictionnalisation qui a une incidence sur la transformation progressive du droit international. La contribution du Tribunal à la juridictionnalisation du droit international est conditionnée par la confiance qu'il inspire. Pour cela, le Tribunal doit être attractif et garantir une bonne administration de la justice. La contribution du Tribunal est également marquée par une spécialisation qui s'inscrit dans les contours de sa juridiction. Si cette dernière est apparemmeut étendue, elle reste en fait volontairement délimitée. La spécialisation influence par ailleurs le rôle joué par le Tribunal de par son incidence sur le développement de la règle de droit par les juges et sur la place du Tribunal dans l'ordre juridique international.
