The examination of the economic rights via the ECHR is astonished because this Convention guarantees Human Rights of a political and civil nature. Thus, considering the increasing role of the State in the economic sector, the European Court had to open the praetorium to the salaried or independent workers and the economic operators. She has justified this standpoint by claiming that there is no impenetrable barrier between civil and political rights on the one hand and economic, social and cultural rights on the other. The effective protection of the rights of the ECHR implies therefore a restricting judicial control of the economic rights which until now only the European Court is able to provide on an European level on the basis of the articles 4, 6 to 11, 14 of the ECHR and 1st of Protocol n°1. Via a systemization of the interpretation of economic rights on the basis of the material rights of the ECHR, the Court confirms the thesis of Human Rights endowed with an economic dimension.

L'examen des droits économiques à travers la CEDH surprend, dans la mesure où cette convention garantit des droits de l'homme de nature civile et politique. En égard au rôle grandissant de l'Etat en matière économique, la Cour européenne a dû ouvrir le prétoire aux travailleurs salariés ou indépendants et aux opérateurs économiques. Elle l'a justifié en affirmant qu'il n'existe pas de cloison étanche entre les droits civils et politiques et les droits économiques, sociaux et culturels. La protection effective des droits de la CEDH impliquait donc un contrôle contraignant de nature juridictionnelle des droits économiques, que seule la Cour européenne peut, pour l'heure, assurer au plan européen sur le fondement des articles 4, 6 à 11, 14 CEDH et 1 du Protocole n°1. Par une systématisation de l'interprétation des droits économiques sur le fondement des droits matériels et procéduraux de la Convention, la Cour conforte donc la thèse de droits de l'homme dotés d'une dimension économique.
