In international humanitarian law, applying the principle of proportionality involves two levels of legality concerning attacks. The principle of proportionality requires the limitation of the attacks to the strict necessity: attacks have to be limited to military objectives and conducted in accordance with precautionary duties. Recent armed conflict actors’ practice calls for a reaffirmation of the conditions to realize such dutides, constituting the framework for applying the principle. The second level of legality refers to the inherent function of the principle by requiring an assessment of the proportionality of the attack. Respecting proportionality in attacks prohibits causing predictable effects that are too significant on civilians and civilian property. Respecting this second level of legality in attacks is essential to realize the principle of distinction.

En droit international humanitaire, l’application du principe de proportionnalité fait intervenir deux niveaux de licéité des attaques. Le principe de proportionnalité requiert la limitation des attaques à la stricte nécessité : les attaques doivent être limitées aux objectifs militaires, et menées conformément aux obligations de précaution. La pratique des acteurs des conflits armés récents oblige à réaffirmer les conditions de réalisation de ces obligations qui constituent le cadre d’application du principe. Le second niveau de licéité se réfère à la fonction propre du principe en exigeant l’évaluation de la proportionnalité de l’attaque. Le respect de la proportionnalité dans l’attaque interdit les effets prévisibles trop importants sur les personnes et les biens civils. Le respect de ce second niveau de licéité des attaques est indispensable à la réalisation du principe de distinction.
