Since the adoption of the oil pollution act in 1990 by the us congress, there is a splitting of the law of civil liability for oil pollution damages, beetween the international system of law, france has adhered to, and the american system of law. However, the comparative analysis of the french and american systems of civil liabilty reveals the basements of a potential harmoniszation of law. Therefore, the necessary and urgent realizationof a new oil juridical order is conceivable

Depuis l'adoption de l'opa 90 par le congres americain, on assiste a un eclatement du droit de la responsabilite civile pour dommages petroliers entre le systeme juridique international auquel la france a adhere, et le systeme juridique americain. Toutefois, l'analyse comparee de ces deux regimes, francais et americain, de responsabilite civile revele l'existence des fondements d'une possible harmonisation. La necessaire et urgente realisation d'un nouvel ordre juridique petrolier s7avere donc envisageable
