L'Internet : un espace de non-droit pour le racisme? : contribution à l'étude des techniques de protection contre les propagandes racistes sur l'Internet

Network of the networks, the Internet has developed in an exponential way in our society, by facilitating the exchanges and the international business. But this " motorway for data ", easing the circulation of knowledge, has not prevented the diffusion of racist materials. Hence, some net surfers have taken advantage of this way of communication to spread out xenophobic ideologies and this new evil was fought out by antiracist lobbies. Taking advantage of the newness of this media, these authors have pretended, as a first excuse, the myth of the legal emptiness, then have persisted in their action in countries where the laws were the most favourable. Under the protection of the first amendment of the US Constitution, Nazis paraphernalia have been sold in the name of the liberty of expression, and in the same time securing accessibility in France. Last, they have invoked the technical constraints. This additional difficulty added to the parties involved others actors, indirectly liable, because although they are not at the origin of the material, however they permit the technical access to it.

Réseau des réseaux, l'Internet s'est développé de manière exponentielle dans notre société en favorisant les échanges et le commerce mondial. Mais cette autoroute de l'information, bien que facilitant la connaissance, n'a pas pu empêcher la diffusion de contenus racistes. Ainsi certains internautes ont profité de cet outil de communication pour faire la propagande d'idéologies xénophobes, et c'est ce nouveau fléau que des associations antiracistes ont combattu. Profitant de la nouveauté de ce média, ces auteurs ont invoqué dans un premier temps le mythe du vide juridique pour se disculper, puis ont par la suite poursuivi leur action dans des pays où la législation leur était plus favorable. Ainsi, sous le couvert du 1er amendement de la Constitution Américaine, des objets nazis pouvaient être vendus au nom de la liberté d'expression tout en étant accessibles en France. Enfin, c'est sous l'angle de l'impossibilité technique que les diffuseurs se sont retranchés. Cette difficulté supplémentaire a fait entrer dans le conflit d'autres acteurs indirectement responsables car, bien que n'étant pas à l'origine de la propagande, ils en permettaient néanmoins techniquement l'accès.
