This study is about "cassation" in penal law in irakian law. It's the first of the kind. And this a post-preliminary chapter oleacing about the historical evolution of "pourvoi en cassation". Twi distinct parts : the first is about the procedure of "le pourvoi en cassation". In the first chapter, we have done a study about "les votes de recours" and "le pourvoi en cassation" in irak, while in the second chapter, we have tried to expose the subject on "le pourvoi en cassation". In the third chapter, we have studied the procedure and its application. In opposit, the second part treats about the control of the "cour de casation". In the first chapter, we have analyzed the cases of "cassation" and in a second chapter, we have studied the question regarding "la rectification de l'arret de cassation". Finally in general conclusion, we habe brought into light the results of the specific research.

Cette etude portant sur la cassation en matiere penale en droit irakien, est la premiere du genre. Elle comprend une introduction precisant l'importance du sujet et les raisons de son choix. Puis un chapitre preliminaire exposant l'evolution historique du pourvoi en cassation. Deux parties ont ete ensuite degagees. La premiere portant sur la procedure du pourvoi en cassation. Dans le chapitre premier, on a procede a l'analyse des votes de recours et du pourvoi en cassation en irak, alors que dans le chapitre second, on a tente d'exposer les decisions susceptibles du pourvoi en cassation. Quant au chapitre troisieme, il a ete consacre au deroulement de la procedure. La deuxieme partie porte, en revanche, sur le controle de la cour de cassation. Dans son premier chapitre, en revanche, on a analyse des cas d'ouverture a cassation, et dans un second chapitre, on a expose la question de la rectification de l'arret de casstion. Enfin, la conclusion generale a ete consacree aux resultats auxquels nous sommes parvenus a la fin de cette recherche.
