The importance and the variety of the damages likely to be caused by oil spills have led the international community to adopt a special system of responsability coupled with a compensation scheme. This system which calls on insurance and contributions from the oil industry, should make an action easier for the victims on one hand by the instauration of objective reponsability, and on the other offer them satisfactory compensations through the socialization of reparations. The occurence of catastrophies such as the one of the amoco cadiz has revealed the shortcomings ont the limits of this convention system whose principles and applications are satisfactory whenever an accident of lesser importance is concerned.

L'importance et la variete des dommages susceptibles d'etre causes en cas de marees noires ont conduit la communaute internationale a adopter regime special de responsabilite double d'un mecanisme d'indemnisation. Ce regime qui fait appel a l'assurance et a des contributions de l'industrie petroliere devait, d'une part, faciliter l'action des victimes par l'instauration d'une responsabilite objective et, d'autre part, offrir a celles-ci des indemnisations satisfaisantes par la socialisation de la reparation. La survenance d'accidents catastrophiques - tels que celui de l'amoco-cadiz - a revele les insuffisances ou les limites de ce systeme conven- tionnel dont le principe et la mise en oeuvre restent toutefois satisfaisants lorsqu'il s'agit d'un accident de faible ou de moyenne importance.
