Une approche juridique des compétitions sportives internationales : l'exemple du football

In order to achieve a juridical study of the international sports competitions, we have studied, on the one hand, the competition itself, and on the other hand the management of the hazards resulting from its organisation. In the first chapter of the first part, we present the international bodies which administer the competitions and the national associations which present the athletes. The second chapter studies the unfolding of the competition. After a presentation of the rules, we study the obligations and liabilities of the international federations, the national association of the host country, the contestants, and especially the athletes. The second part starts with a chapter devoted to the safety of the spectators. First, we analyze the obligation of safety for which the organizers are responsible, and then, we describe the role of the public authorities, according to the french law. The last chapter deals about the insurance policies. On one side, we enumerate the risks insured, and on the other side we analyze the various methods adopted by the organizers for an effective protection.

Pour l'etude juridique des competitions sportives internationales, nous avons etudie d'une part l'epreuve sportive proprement dite, et d'autre part la gestion des risques inherents a son organisation. Le premier chapitre de la premiere partie se consacre a l'examen des structures d'encadrement de l'epreuve sportive. Premierement, nous procedons a une typologie des differentes associations nationales. Ensuite nous presentons une analyse juridique des federations internationales. Le deuxieme chapitre etudie le deroulement de l'epreuve sportive. Apres une presentation des sources des obligations des acteurs, sont etudiees les obligations et les responsabilites de la federation internationale organisatrice, de l'association nationale du pays hote, et des participants, avec une attention particuliere pour les athletes. La deuxieme partie debute par un chapitre consacre a la securite des spectateurs. Premierement, est effectuee une etude de l'obligation de securite a la charge des organisateurs, et ensuite nous considerons, dans le cadre du droit francais, l'implication des pouvoirs publics dans la gestion de ce risque. Le dernier chapitre s'interesse a la couverture des risques de l'epreuve sportive. Dans un premier temps nous passons en revue les risques couverts et dans un second temps nous examinons les diverses modalites envisagees par les organisateurs pour une garantie efficace.
