Abstract EN:

The law of august 4, 1992 has put an end to an anachronistic situation. It has subdued employer's disiplinary power to a disciplinary law inspired from criminal law. However, because of their similar repressive nature, criminal law and disciplinary labour law aim at the same fundamental rules which are inherent in the ideal of justice. On the other hand, the rules which permit concrete application of fundamental rules, present a real praticularism in each subject. Actually privat firm looks for an economic purpose; so criminal rules are too much stiff to be used in it. The firm's interest needs more flexible rules which can be conciled with an important discretionary employer's power necessary to permit a constant adaptation of the firm to its unstable surroundings.

Mettant fin a une situation anachronique, la loi du 4 aout 1982 a soumis le pouvoir disciplinaire de l'employeur au respect d'un droit disciplinaire inspire du droit penal. Toutefois, si en raison de leur nature repressive commune droit penal et droit disciplinaire du travail tendent vers d'identiques principes generaux inherents a l'ideal de justice, en revanche, les principes techniques qui en assurent la mise en oeuvre presentent une incontestable specificite d'un domaine a l'autre. En effet, institution privee a finalite economique, l'entreprise ne saurait s'accommoder de la rigidite des regles du droit penal; son fonctionnement implique la reconnaissance d'un important et irreductible pouvoir discretionnaire au profit de l'employeur.
