La faute dans l'application de l'article 1384 alinea 1 du code civil

The article 1384 paragraph 1 of the french civil statute book has been used as an autonomous way for an hundred years. The jurisprudencial development of this text is reported to be based on an incresing call to an objective view of liability. But, thinking it over this assertion must be moderated. The offence keeps it's place within the appreciation of the characters owning to the thing as well as in the designation of its owner. It appears again in the applying of the article 1384 paragraph 1 of the french civil statute book when one must know if the object had or hadn't an active or passive behaviour in the achievement of the prejudice, and when the owner who wants to be free himself, wants to establish an exonerative fact. Whatever the level we are considering, it doesn't only depend, as one might think, on the victim's fault or on somebody'else's but also on the owner's.

L'article 1384 alinea 1 du code civil a cent ans d'existence dans son utilisation autonome. L'on a l'habitude de dire que l'evolution jurisprudentielle relative a ce texte est caracterisee par un appel croissant a une vision objective de la responsabilite. Mais, a l'analyse, on s'apercoit que cette affirmation ne peut etre que temperee. La faute garde sa place aussi bien dans le cadre de l'appreciation des caracteres propres a la chose que dans celui de la designation de son gardien. Elle reapparait egalement a l'occasion de la mise en oeuvre de l'article 1384 alinea 1 du code civil, lorsqu'il s'agit de determiner si l'objet a eu un comportement actif ou passif dans la realisation du dommage, enfin lorsque le gardien, voulant se liberer, entend etablir un fait exoneratoire. A quelque niveau que l'on se place, il ne s'agit pas seulement, comme on pourrait le supposer, de la faute de la victime ou de celle d'un tiers, mais aussi de celle du gardien.
