The partial resolution testifies the will of insuring proportionality between the default and its punishment. It can happen in space and in time. Partial resolution could happen in space when the judge reduces the creditor's engagement equal to the debtor's one. Moreover the mitigation, partial resolution could happen by means of a cut. In the case, we have to analyse if the judge can or not pronounce a resolution and keep, in the same time, some contract's clause. Partial resolution could happen in time when the one doesn't bring about the retrospective annihilation. Resolution is limited to the effects that contract can produce in the future. This solution could be put into effect to the successive execution contracts. Both partial resolutions could be criticised. . .

La résolution partielle marque la volonté d'assurer une certaine proportionnalité entre l'inexécution et sa sanction. Elle peut se produire dans l'espace et le temps. Il y aurait résolution partielle dans l'espace lorsque le juge diminue l'obligation du créancier à hauteur de celle du débiteur. Outre la réduction, la résolution partielle pourrait se réaliser par une amputation. Il s'agit de savoir si le juge peut prononcer une résolution partielle dans le temps quand celle-ci n'entraîne pas la mise à néant rétroactive du contrat. La résolution est limitée aux effets que le contrat pourrait produire dans l'avenir. Cette solution s'appliquerait aux contrats à exécution successive. Ces deux résolutions partielles encourent la critique. La résolution partielle matérielle repose sur une conception unitaire du contrat : Le contrat se résume à son effet créateur d'obligation.
