The purpose of the thesis is to study, in three parts, the principal difficulties which the promise to sell poses for the notarial practice. The first part is devoted to the unilateral or synallagmatic characteristic of the promise which in practice becomes tenuous because of the use of certain clauses. However, the very validity of the promise may be dependent upon such characteristic. The second part deals with the assimilation of the promise to sell expressed in article 1589 of the civil code, which demonstrates that the use of the promise to sell requires the acknowledgement of its relative autonomy ; it would however be dangerous to countenance its independence pure and simple. The third part concerns the fulfillment of the promise to sell ; after the study of certain terms and conditions of fulfillment, the risks of same are considered (the problems of refusal to fulfill, enforceability vis-a-vis third parties, the overprotection of the purchaser under the law of july 13, 1979).

La these a pour objet l'etude en trois parties des principales difficultes que pose la promesse de vente a la pratique notariale. La premiere partie est consacree a la qualification unilaterale ou synallagmatique de la promesse qui est rendue fragile en pratique a cause de l'utilisation de certaines clauses. Or, de la qualification peut dependre la validite meme de la promesse. La deuxieme partie traite de l'assimilation de la promesse a la vente enoncee a l'article 1589 du code civil. Il y est montre que l'utilisation de la promesse de vente necessite la reconnaissance de sa relative autonomie, mais qu'il serait dangereux de consacrer son independance pure et simple. La troisieme partie concerne l'execution de la promesse de vente ; apres l'etude de certaines modalites d'execution, sont envisages les aleas de cette derniere (problemes de refus d'executer, d'opposabilite aux tiers, de surprotection de l'acquereur aux termes de la loi du 13 juillet 1979).
