The subject of this thesis is to consider the problem of in kind compensation as regards both the contractual responsibility and the criminal responsibility. In each of the above parts the definition of such a notion has been considered at first : its implementation has been anticipated in a second stage. This work tries to prove the possible extension or transposition of the results obtained in the first case to the second one.

Cette these a pour objet d'examiner tour a tour la question de la reparation en nature, d'une part en matiere de responsabilite contractuelle et d'autre part, en matiere de responsabilite delictuelle. Au sein de chacune de ces parties, a tout d'abord ete envisagee la definitioin de cette notion, puis sa mise en oeuvre. Ce travail essaie de demontrer une extension ou une transposition des solutions retenues dans la premiere hypothese a la seconde.
