Three sets of provisions can be found in the field of copyright and industrial property. The first set of provisions deals with the definition of the legal relationship between a subject under law and an object. This relationship may consist in a tight link of identification between the subject and the object going as far as creating a single identity which is opposable to third parties (the so called "adherence relationship"). It can also be defined as being essentially a relationship between the subjects because of the break between the subject and the object, said object becoming a mere good, an instrument of production and sale (the so called "exploitation relationship", which under industrial property and copyright may be analysed as a prohibiting relationship). The second set of provisions deals with the structure of entity composed by the subjects under law; this structure can be a structure of exclusivity under the so called "adherence relationship" and the so called "exploitation relationship" when the existence of a legal relationship between a subject under law and an object prohibits the creation of another relationship between the same subject and another object; it can also be the structure of freedom but only under the so called "exploitation relationship" (free competition, free movement of goods, freedom for contracting) when all subjects can establish a relation with all objects. The third set of provisions aims to set up in connection with the so called "exploitation relationship" a solution to the conflicts which may arise between on one hand the structure of exclusivity (exclusive right - exclusive licence) on the other hand the structure of freedom (free competition, free movement of goods, freedom for contracting). Le domaine de la propriete litteraire, artistique et industrielle en droit francais et communautaire, met en jeu trois types de dispositions. Les premieres sont relatives au contenu des relations juridiques entre un sujet de droit et un objet. Cette relation peut consister en un lien etroit d'identification entre le sujet et l'objet au point que l'ensemble constitue un couple dont le respect s'impose aux tiers-sujets (relation d'appartenance); elle peut aussi se definir comme une relation essentiellement entre sujets du fait de la coupure entre sujet et objet, ce dernier devenant simple marchandise, instrument de production ou de vente (relation d'exploitation qui, dans ce domaine s'analyse meme comme une relation d'interdiction). Les secondes sont relatives a la structure conferee a la pluralite composee de l'ensemble des sujets de droit; il peut s'agir de la structure de l'exclusivite dans le cas de la relation d'appartenance (droit moral) et de la relation d'exploitation (droits patrimoniaux) des lors que l'existence d'une relation juridique entre un sujet de droit et un autre element rend impossible l'etablissement de cette meme relation pour un autre sujet; il peut s'agir de la structure de la liberte mais dans la seule hypothese de la relation d'exploitation (libre concurrence, libre circulation, liberte de contracter) des lors que tous les sujets peuvent etablir une relation avec un autre element. Les troisiemes dispositions visent ainsi a trouver, au sein de la relation d'exploitation, une solution au conflit des structures d'exclusivite (droit exclusif d'exploiter, licence exclusive) et de liberte (libre concurrence, libre circulation, liberte de contracter). Ces dispositions peuvent soit donner une solution a priori, soit se presenter comme des regles de flexibilite.
