The aim of policy of prices in algeria is to increase the national production but it supposes that the distribution is mastered. Thus,a necessary connection of the functions of production and distribution is provoked by the concption of a policy of prices. An economy open to the internationalmarket must own the most competitive prices. Apparently it is not when acting artificially on the prices that one can obtain competitive prices. The necessity to orientate the national production and to reorganize the management of enterprises is imperative in algeria. It must be done while respecting the generalprinciples of common law,i. E. The principles of competence,of liberty of trade and industry,and finally that of equality. Contentious matters are provoked by the application of the policy of prices. As a matter of fact,after having brought its contribution to the formation of the rule of law,with the elaboration of the policy of prices,the administrative action is going on at the time of its application. La politique des prix en algerie vise a augmenter la production nationale mais suppose que soit maitrises la distribution. Des-lors, la conception d'une politique des prix doit-etre a l'origine d'une articulation necessaire et souhaitee des fonctions de production et de distribution. Une economie ouverte au marche internationnal doit posseder les prix les plus competitifs, et ce n'est, manifestement pas une resistance passive a la hauses determinant artificiellement les prix, qui est susceptible de repondre a un tel contexte. La necessite d'rienter la production nationale et d'assainir la gestion des entreprises en algerie est imperative. Cela doit se faire dans le respect des principes generaux de droit commun, a savoir, les prin cipes de competence, de liberte du commerce et celui de l'egalite. De l'application de la politique des prix, naissent des contentieux. En effet, apres avoir apporte sa contribution a la formation de la regle de droit, par l'elaboration de la politique des prix, l'action administrative se poursuit lors de son application. Se trouvant investie de pouvoirsd'investigations, l'administration doit prendre en consideration la garantie des droits des prevenus en respectant le principe de la separation des pouvoirs.
