The legal issues of artificial intelligence have been the subject of various legal studies. Being an autonomous data processing system, artificial intelligence is a result of the combination of algorithms and data which are respectively grouped into software and databases. However, this technological entity acts in a way that brings it closer to a natural person. In this context, firstly, the aim of this study is to propose a legal qualification for artificial intelligence. In particular, this approach aims to analyze the opportunity and the need of the recognition of a new legal status for artificial intelligence, as well as analyze the possibility of establishing a right to property for this phenomenon. Secondly, there is a necessity to provide a legal framework for the functioning of artificial intelligence in different fields of law. Finally, the purpose of the study is to analyze the adaptation of several legal liability frameworks to the specificities and difficulties of artificial intelligence.

Les enjeux juridiques de l’intelligence artificielle font l’objet d’études diverses. Etant toujours un système de traitement de données fonctionnant de manière autonome, l’intelligence artificielle résulte de la combinaison d’algorithmes et de données qui sont respectivement regroupés en logiciels et en bases de données. Cependant, cette entité technologique agit d’une manière qui la rapproche d’une personne physique. Dans ce contexte, il s’agit dans un premier temps de proposer une qualification juridique pour l’intelligence artificielle. Particulièrement, la démarche consiste à réfléchir à l’opportunité et à la nécessité de la reconnaissance d’un nouveau statut de l’intelligence artificielle, ainsi qu’à analyser la possibilité de l’appropriation de ce phénomène. Dans un second temps, se pose la question de l’encadrement juridique du fonctionnement de l’intelligence artificielle. Dans un dernier temps, la finalité de l’étude consiste à analyser l’adaptation de plusieurs régimes juridiques de responsabilité aux spécificités et difficultés propres à l’intelligence artificielle.
