In frensh law, the relations between the engagement of workman and the collective bargain of labour are relations of dependance and competition. The collective bargain of labour depends upon the engagement of workman, or, rather, upon its main characteristic, because it produces its effects only upon a subordinated job, confining thus the power of the employer. Sometimes, the engagement of workman depends upon the collective bargain of labour, when it settles the conditions of conclusion, of keeping up and of breach. It is the same when the fullfilment or the suppression of some arrangements of the collective bargain of labour change the subordinated job. The competition is mainly regulated by the law, wich forcasts the application of the most favourable provision. But the engagement of workman and the collective bargain of labour sometimes forcast themselves this competition. Besides, the derogatory clauses of some collective bargain of labour modify radically the relations with the engagement of workman : henceforth they allow the employer to expand his powers.

Les rapports du contrat de travail et la convention collective sont des rapports de dependance et de concurrence. La convention collective depend du contrat de travail ou, plutot, de sa principale caracteristique, car elle ne produit ses effets que sur une relation de travail subordonne, en limitant, en principe, l'etendue des pouvoirs de l'employeur. Parfois, le contrat de travail depend de la convention collective, lorsque celle-ci en fixe les conditions de conclusion, de maintien ou de rupture. Il en est de meme lorsque l'application ou la suppression de certains amenagements conventionnels modifient la relation de travail. La concurrence est principalement reglee par l'article l 135-2 du code du travail, qui prevoit l'application de la disposition la plus favorable. Mais le contrat de travail et la convention collective amenagent parfois eux-memes les conditions de cette concurrence. En outre, l'emergence des accords derogatoires modifie radicalement les liens entre le contrat de travail et la convention collective, laquelle permet desormais a l'employeur d'etendre l'exercice de ses pouvoirs.
