Can we really speak of right to the social security in tunisia? The answer cannot be but uncertain. Our law has been, in fact, evolving in the ambiguity of the choice of its forms of organisation on account of the multiplicity of the models of construction which has prompted the accomplished legislative work and the failing of a change of an original model. The tunisian legislative has "akwardly" misused the diferent models that have been proposed to it or imposed on. It settled itself on the fringe of the type of solidarity (broad soladarity) which governs the whole social structures and has set up a fragmentary social protection for the benefit of only a few categories of the society. That is the reason of the impermability and scaterring of the structure of management. The multiplicity of the models which inspired the tunisian legislative has also led to the disappearence of the notion of the social risk which appears dissociable in its different dimensions. The tunisian system shows today a particular stature charecterized by the coexistence of two different types of protection offering moderate and uncongrous prestations which would reduce the social security system to a mere charitable practice.

Peut-on veritablement parler, en tunisie, d'un droit a la securite sociale? La reponse a cette question ne peut etre qu'incertaine. Notre droit evolue, en effet, dans l'ambiguite du choix de ses formes d'organisation en raison de la multiplicite des modeles de construction qui ont inspire l'oeuvre legislative accomplie et la defaillance d'un modele original de rechange. Le legislateur tunisien a "maladroitement" manipule les divers modeles qui lui ont ete proposes ou imposes. Il s'est situe en marge du type de solidarite (elargie) qui gouverne l'ensemble des structures sociales et a organise une couverture sociale fragmentaire limitee a des solidarites categorielles. Elle est a l'origine de l'impermea- bilite et de l'eparpillement des structures de gestion. La multiplicite des modeles d'inspiration a aussi debouche sur l'eclatement de la notion du risque social qui apparait comme dissociable dans ses differentes dimensions. Le systeme tunisien est actuellement d'une physionomie particuliere caracterisee par la coexistence de deux secteurs offrant des prestations modiques et disparates qui risquent d'amener la securite sociale a une simple technique charitable.
