All research bearing on the mentally-ill closely associates the legal status of the patient and his health environment, and is organized to respond to his health needs. Both aspects, legal and sanitary, have been organized most often into the framework of special and particular institutions. The object of the report is to prove that we are witnessing today a drastic evolution : these special mental health system and legal status of the patient are nowadays obsolete due to the marked emphasis on the integration process of the patient into society, and as the result of the development of a normalized health care system and status of the patient the french mental health care system is caracterized by a specific legal and institutional organization aiming at a real integration. A real desire of integration is expressed in the different reforms indertaken since the instauration of the "sectorization policy" in 1960. The legal status of the mentally-ill is inscribed in a simplified legal context where we can still recognize some areas of specificity.

L'integration du malade mental dans la societe civile : prise en charge sanitaire et statut juridique. Toute etude portant sur les malades mentaux associe etroitement le statut juridique du patient et l'organisation sanitaire mise en place pour repondre a des besoins de sante. Ces deux aspects, juridique et sanitaire, ont ete organises, le plus souvent dans le cadre d'institutions et de dispostions speciales, exhorbitantes du droit commun. L'objet de la these est de demontrer que l'on assiste aujourd'hui a une evolution tres nette : ce caractere special du systeme de sante mentale et du statut juridique du patient est aujourd'hui battu en breche par une tendance tres nette a l'integration du malade mental dans la societe civile, grace a l'emergence d'un systeme de soins banalise et d'un statut juridique de droit commun. La prise en charge sanitaire du malade se caracterise par une organisation juridique et institutionelle specifique au service d'une veritable integration. Une reelle volonte d'integration s'inscrit dans les differentes reformes entreprises depuis l'instauration de la politique de secteur en 1960. Le statut juridique du malade mental s'inscrit dans un cadre juridique banalise ou l'on constate encore quelques ilots de specificite.
