Despite of numerous specific regulations, the "code civil" still contains the major rules which govern the contract of mandat. This contract has however deeply changed. Traditionaly considered as a free engagement, the mandat became a professionnal contract. Such an evolution undoubtfully intefered with the mandatorie's obligations. Analysing meticulously the terms of the development, the present work proposes a detailed study of the existing french rules of the nature and system of these obligations. The task consists mainly in pointing out the extended mission of the contemporary mandatory and its reinforcement, especially in case of an authorized substitution. It also enhances an unknown aspect of the obligation to render an account : the duty to inform.

Malgre la multiplication de reglementations specifiques, le regime du mandat resultant du code civil a conserve toute sa portee. Or le mandat a profondement evolue. Concu par le code civil comme un contrat gratuit par nature, il est devenu aujourd'hui une technique essentiellement professionnelle. Une telle evolution n'a pu manquer de se repercuter sur le regime de ce contrat, et specialement sur les obligations du mandataire. Cette these se propose donc de faire le point de cette evolution par un examen minutieux de l'objet et du regime de ces obligations en droit positif. Elle met notamment en evidence l'extension de la mission du mandataire contemporain a des actes materiels, un renforcement de l'obligation d'executer la mission, specialement en cas de substi-tution de mandataire autorisee, et enfin un aspect meconnu de l'obligation de rendre compte, laquelle ne se ramene pas a la presentation d'un compte mais comporte en outre un devoir d'informa-tion.
