The lack of a definition of the buiding in french law creates an obvious legal gap which does not preclude the existence of a genuine notion of what a building actually is. This absence has been established in different branches of law and makes the interpretation of clauses difficult and the harmony of the harmony of the legal structure precarious. Though it is possible, especially from the civil code, to derive the basic elements of the notion, it becomes more difficult to apply it accurately, owing to the somewhat unorthodox uses of the word by the legislator. This being so,the study of the notion of building should be complemented by a close survey of its range of significance notably as compared with such alternative notions as construction, edifice, constructive works. Moreover the progress in building techniques is already upsetting many established routines; largely influenced by material constraints the notion of building must be also specified in relations to both its environment and equipement wich are constantly evolving. The notion of building, being a specific type, with a specific purpose, deserves a better delineation of its specific domain than it presently has. If for the notion of building such as appears in the present study, improvements are still possible and even necessary, the frst step to be taken will concern the specifying of the encroaching related notions.

L'absence de definition du batiment en droit francais constitue un vide juridique apparent qui n'empeche en rien l'existence d'une veritable notion du batiment cette absence constatee dans differents domaines du droit rend l'interpretation des dispositions delicate et l'harmonie de l'edifice legislatif fragile. S'il est possible de degager, notamment a partir du code civil, les fondements de la notion, il devient difficile d'en faire une exacte application a cause des utilisations peu orhtodoxes du terme par le legislateur. Dans ces conditions, l'etude de la notion de batiment doit etre completee par l'etude de sa portee notamment vis a vis des autres notions telles que construction, ouvrage, edifice, dont l'utilisation n'est pas non plus toujours parfaite. En outre, le progres technique qui affecte le secteur de la construction vient bouleverser bien des habitudes : largement influencee par les contraintes materielles, la notion de batiment doit aussi etre precisee par rapport a son environnement et a son equipement en evolution constante. Construction d'un type particulier, affectee d'une destination specifique, la notion de batiment merite un domaine mieux delimite qu'il ne l'est actuellement. Si des ameliorations de la notion telle qu'elle ressort de cette etude sont encore possibles, voire meme necessaires, ce sont dans un premier temps les autres notions qu'il y a desormais lieu de preciser.
