While american venture capital investors can organize very easily the protection of their investments, the contractual freedom of french investors is limited by several provisions of the business law code. It is however possible for french venture capital investors ot obtain contractual protections through shareholders agreements and specific charter's provisions.

Contrairement a son homologue americain, l'investisseur en capital risque francais voit sa liberte contractuelle limitee par differents principes de droit des societes. Il est cependant possible d'organiser par le biais de pactes d'actionnaires et de privileges statutaires un cadre juridique offrant une protection satisfaisante a ce type d'investissement.
