The strait of hormuz connect the persian gulf, a semi-enclosed sea, and the gulf of oman, an open sea. The region of the persian gulf have its specific situation. The cardinal point is the protection of the legitimate interests of coastal states and promotion of international trade. Straits should not be subjected to a special regime, because they were part and parcel of the territorial sea and should be viewed as such. Iran and oman require the application of the right of innocent passage to both the territorial sea and the strait used for interntaional navigation. But, irak demand the application of free transit through the strait of hormuz and freedom of navigation in the area as a whole.

En tant que mer semi-fermee, le golfe persique est relie au golfe d'oman, mer libre, par le detroit d'homuz. La region du golfe persique a sa propre situation geographique. Pour les etats riverains du golfe persique, le probleme essentiel est la protection de leurs interets legitimes ainsi que le developpement du commerce international. Pour certains etats, les detroits ne doivent pas etre soumis a un regime juridique special car ils font partie des eaux territoriales des etats riverains et ils doivent etre consideres comme tels l'iran et l'oman exigent l'application du droit de passage inoffensif alors quel'irak demande l'application du droit de passage en transit a travers le detroit d'hormuz.
