8the senegalese system of banking guarantees is nowadays caracterized by some slackness and insuffisciencies which display an anachronic situation. The real sureness, victim of the collective proceeding combined to a hostile law-making have shown the limit of their efficiency. Concerning the depositsthough its pliablity, the success remain softened for sociological reasons. Therefore, a reformation is necessary to fit the current legislation to the banking guarantees and a new determination of banking system regarding of the relationships between bankers and custommers.

Le systeme senegalais des garanties bancaires se caracterise actuellement par un certain nombre d'insuffisances et de carences qui traduisent un etat anachronique. Les suretes reelles, victimes d'une legislation fonciere defavorable et des procedures collectives, ont demontre les limites de leur efficacite. Quant au cautionnement malgre sa souplesse, son succes demeure mitige pour des raisons d'ordre sociologique. Des lors, une reforme s'impose en vue d'adapter le droit actuel au contexte senegalais. Celle-ci passe par un renouvellement des garanties bancaires et une redefinition du systeme bancaire pour tenir compte des rapports entre banquiers et clients.
