The twentieth century was the theatre of a continuous contracting of the family group around its core developing the place of surviving spouse. However, its social statute always does not have to him permais to reach a successional statute. Even if Germany and England quickly granted a place of favour to him, it were necessary to await the law of december 3, 2001, so that the successional rights of french spouse surviving are revalorized. But did this marital promotion set up a protective structured successional statute of surviving spouse or they are only new scattered improvements? If such a statute exists, how is it located compared to its equivalents german and english? The patrimonial protection of the spouse surviving is in the middle of the comparative study of the french, german and english legislations. Whatever the studied legislation, the determination of this statute is carried out thus around two axes : legal protection and the voluntary protection of the surviving spouse.

Le vingtième siècle a été le théâtre d'un rétrecissement continu du groupe familial autour de son noyau valorisant ainsi la place du conjoint survivant. Cependant, ce statut social ne lui a pas toujours permis d'accéder à un statut successoral. Même si l'Allemagne et l'Angleterre lui ont rapidement accordé une place de faveur, il a fallu attendre la loi n°2001-1135 du 3 décembre 2001 pour que les droits du conjoint survivant français soient revalorisés. Mais cette promotion conjugale a-t-elle mis en place un statut successoral structure protecteur du conjoint survivant ou ne s'agit-il que de nouvelles améliorations éparses? Si un tel statut existe, comment se situe-t-il par rapport à ses équivalents anglais et allemand? La protection patrimoniale du conjoint survivant est au coeur de cette étude comparative des droits français, allemands, anglais. Quelle que soit la législation étudiée, la détermination de ce statut s'effectue autour de deux axes : la protection légale et la protection volontaire du conjoint survivant.
