While being enigmatic, the notion of «constitutional identity» of France brings up issues largely exceeding the sole items related with the French Constitution characteristics. It gets back indeed to the theory of state and from what constitutional power is made of when being adapted to European integration characterizing both the national constitutional basis and the contentious dimension of the supreme norm, the constitutional identity is a «case law» concept aiming to solve conflicts between norms inherent in the European integration. By defining the constitutional identity as an attribute of a member State of the European Union, the Conseil constitutionnel contributed in a major way on how to modelize interactions between systems. This notion now helps to further clarify the European construction with the adaptation of the State's theoritical foundations in relation with its changing institutional environment.

Enigmatique, la notion d’identité constitutionnelle de la France évoque des enjeux qui dépassent de loin la désignation des éléments qui caractérisent la Constitution française. Elle renvoie ainsi à la théorie de l’Etat et du pouvoir constituant, adaptée au cadre de l’intégration européenne. Désignant à la fois le socle constitutionnel national et la dimension contentieuse de la norme suprême, l’identité constitutionnelle est un concept jurisprudentiel destiné à résoudre, dans l’ordre juridique interne, les conflits de normes inhérents à l’intégration européenne. La protection de l’identité constitutionnelle de la France est une position de principe, reprise par plusieurs Cours constitutionnelles, qui renvoie à la maîtrise par l’Etat de son destin institutionnel. Cette notion contribue à éclairer d’un jour nouveau la construction européenne, en adaptant les fondements théoriques de l’Etat à son environnement institutionnel mouvant.
