The banker dispensing of informations and advisers for a longtime, the relations between the banker and his clients have been characterized by the omnipotence of the banker who imposed upon the clients his conditions. The important trend of the consumer's protection of the last few years has introduced more transparency in these relations. Consequently, the legislator has interfered by different laws which imposed upon the banker the obligation to inform his clients. The purpose of these laws is to give the client a perfect knowledge of the elements of the contract. The increasing interest of the private individual in the financial products leads them to sollicit the banker's advice, a service which the latter has developed in order to answer the client's demand. . .

Le banquier dispensateur d'informations et de conseils pendant longtemps, les relations entre le banquier et ses clients ont ete caracterisees par l'omnipotence du banquier qui imposait aux clients ses conditions. Le fort courant de protection des consommateurs de ces dernieres annees a introduit plus de transparence dans leurs relations. Ainsi, le legislateur est intervenu par differentes lois pour imposer une obligation d'information au banquier. Le but vise est une parfaite connaissance par le client des elements du contrat. L'interet croissant des particuliers pour les produits financiers les conduit a solliciter les conseils du banquier, prestations que ce dernier a developpees pour repondre a l'attente du client. Vis-a-vis de sa clientele d'entreprise, le banquier a su s'adapter aux mutations economiques et financieres et, grace aux innovations technologiques, a developpe l'activite de conseil. De cette convergence d'interets entre le banquier et son client est ne un partenariat qui traduit l'evolution contemporaine des relations entre le banquier et sa clientele d'entreprises.
