The different types of contracts in the flexible workplace are examined in two different ways. Contractual norms interns of external flexibility contract of limited duration, tempory work, subcontracting, contracts for training programmes enabling young people and the long term unemployed to find a job) and contractual norms for internal flexibility (work contracts of unlimited duration, different conventions adopted by companies) ara analysed and compared. It becomes apparent that these contracts of external flexibility are very reglemented. On the contrary, contracts of internal flexibility ensure a certain contractual freedom. Future economic policies probably have to chose between two distinct legal models. Unless the challenge of finding a delicate combinaison is taken up.

L'etude des supports contractuels de la flexibilite s'effectue selon deux axes : les normes contractuelles de flexibilite externe (contrats de travail a duree determinee, pret de main d'oeuvre, sous-traitance et contrats d'insertion - formation) et les normes contractuelles de flexibilite interne (contrats de travail a duree indeterminee, conventions collectives) sont analysees et comparees. Il apparait ainsi que les contrats de flexibilite externe correspondent plus a des statuts qu'a de reels supports contractuels. A l'oppose, les contrats de flexibilite interne autorisent une liberte contractuelle certaine. Les politiques economiques futures devront peut-etre choisir entre deux modeles juridiques. A moins de relever le defi d'une delicate combinaison.
